Terms of Service

Last updated: 31 August 2026 · Effective on first use of the Service.

These Terms of Service (the “Terms”) govern your access to and use of the FOMO API and the fomoapi.io website, documentation, dashboards, data feeds, and related services (together, the “Service”), operated by fomoapi.io (“fomoapi.io”, “we”, “us”, or “our”). By accessing or using the Service, you agree to these Terms.

01Acceptance & eligibility

By requesting an API key, calling any endpoint, connecting to the realtime feed, or otherwise using the Service, you agree to be bound by these Terms and by any usage limits, plan terms, and policies referenced here. If you do not agree, do not use the Service.

You may use the Service only if you:

• are at least 18 years old and able to form a binding contract;
• are not barred from receiving the Service under the laws of your jurisdiction or any applicable sanctions or export-control regime; and
• if you use the Service on behalf of a company or other entity, are authorized to bind that entity to these Terms - in which case “you” means that entity.

The Service is intended for developers and businesses. It is not a consumer trading product and is not offered as one.

02Description of the Service

fomoapi.io is a data API. It aggregates publicly observable, on-chain and social information about crypto traders and resolves trader handles to their on-chain wallet addresses. Through the Service we may provide, among other things:

• resolution of a trader handle to associated Solana and EVM wallet addresses;
• computed profit-and-loss (PnL), trade history, and position data derived from on-chain activity;
• live token holdings and balances;
• ranked leaderboards over various time windows;
• a token-holder / “who-holds-what” graph; and
• two realtime WebSocket feeds of trading events: the app feed stream (/ws/alerts) and, on Growth and above, the on-chain stream (/ws/trades).

The Service is provided as data only. We do not execute trades, custody funds, hold or transmit any digital assets, provide brokerage or exchange services, or act as an intermediary in any transaction. The specific endpoints, fields, coverage, and features available to you depend on your plan and may change over time.

03Plans, billing & free tier

The Service is offered across a free tier and one or more paid tiers. Each plan carries its own call allowances, rate limits, feature set, and price, as described at the point of sign-up or in your order.

• Free tier. Any free or trial access is provided for evaluation and low-volume use, and may be modified, rate-limited, or discontinued at any time without notice.
• Paid tiers. Paid plans are billed in advance on a recurring basis (for example, monthly) in the currency stated at checkout, and, except where required by law, fees are non-refundable. Usage above your plan's included allowance may be rate-limited, blocked, or billed as overage.
• Price changes. We may change plan pricing or the contents of a plan on a going-forward basis; changes take effect on your next billing cycle after we provide notice.
• Taxes. Fees are exclusive of taxes; you are responsible for any applicable taxes other than taxes on our net income.

04Data provided “as is”

The Service and all data made available through it are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the above, we do not warrant that:

• the data is accurate, complete, current, or free of errors - it is derived from third-party chains and sources and from computation, and may be delayed, incomplete, mislabeled, or wrong;
• wallet-to-handle resolution is correct or exhaustive - associations are inferred from publicly observable signals and may include false positives or miss wallets;
• PnL, holdings, or leaderboard figures reconcile with any exchange, wallet, tax, or accounting record;
• the Service, any endpoint, or the realtime feed will be uninterrupted, timely, secure, or available at any particular uptime; or
• the Service will meet your requirements or produce any particular result.

You are solely responsible for independently verifying any data before relying on it, and for how you use it in your own products and decisions.

05Not financial, investment, or trading advice

The Service provides data and information only. Nothing made available through the Service is, or should be construed as, financial, investment, trading, legal, tax, or accounting advice, a recommendation, or a solicitation or offer to buy or sell any asset. We are not your broker, adviser, or fiduciary.

Crypto assets are volatile and high-risk, and you may lose some or all of any capital you deploy. Any trading or investment decision you make is made solely by you, at your own risk, and you are responsible for your own due diligence. Past performance and any historical PnL shown through the Service do not predict future results. To the fullest extent permitted by law, we are not liable for any trading or investment losses connected to your use of the Service.

06No affiliation or endorsement

fomoapi.io is an independent service. We are not affiliated with, sponsored by, endorsed by, or in any partnership with FOMO, fomo.family, fomoscan, or any exchange, wallet, chain, launchpad, trading platform, or the individual traders whose publicly observable activity may be represented in the data.

fomoapi.io independently aggregates and computes data from publicly observable and on-chain sources. All third-party names, handles, logos, and trademarks are the property of their respective owners and are used only for identification and descriptive purposes. Their appearance in the Service does not imply any affiliation with or endorsement by those parties, nor by us of them. We are not responsible for, and make no representations about, any third-party platform, protocol, or trader.

07Acceptable use & rate limits

You must keep your API key confidential; you are responsible for all activity under your key. You agree not to, and not to permit anyone else to:

• exceed, evade, or circumvent the rate limits, call allowances, or access controls of your plan, including by rotating keys, accounts, or IP addresses;
• resell, redistribute, sublicense, or make the raw data or feed available to third parties as a standalone dataset or as if it were an official or first-party feed of any platform;
• represent, imply, or brand the Service or its data as coming from, endorsed by, or affiliated with FOMO, fomo.family, fomoscan, or any other platform;
• use the Service to build a substantially similar competing data API, or to scrape, mirror, or reconstruct our database in bulk;
• use the Service to harass, dox, target, or facilitate harm to any individual, or in a way that violates any person's privacy or other rights;
• use the Service for unlawful purposes, including fraud, market manipulation, money laundering, or sanctions or export-control violations;
• interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its infrastructure, or probe or test its security without authorization; or
• remove, obscure, or misuse any attribution, notice, or restriction we provide.

We may set, change, and enforce rate limits and other technical controls, and we may throttle, suspend, or block requests that we reasonably believe violate these Terms or threaten the stability or integrity of the Service.

08Intellectual property

As between you and us, we own the Service, our software, documentation, and the compilation, structure, and presentation of the data. Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Service and use the data you retrieve within your own applications and internal operations. This license does not permit the resale or standalone redistribution restrictions described in Section 07. We reserve all rights not expressly granted.

09Limitation of liability

To the fullest extent permitted by law, in no event will fomoapi.io or its owners, officers, employees, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or trading or investment losses, arising out of or relating to the Service or these Terms, whether based in contract, tort (including negligence), strict liability, or otherwise, and whether or not we were advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total fees you paid to us for the Service in the three (3) months immediately preceding the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10Indemnification

You agree to defend, indemnify, and hold harmless fomoapi.io and its owners, officers, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your products or services that incorporate the Service or its data; (c) your violation of these Terms or of any law; or (d) your violation of any third party's rights, including privacy or intellectual-property rights.

11Suspension & termination

You may stop using the Service at any time. We may suspend, rate-limit, or terminate your access, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or to protect the Service or other users. On termination, your license and your right to access the Service end. Sections that by their nature should survive - including “as is” disclaimers, not-financial-advice, no-affiliation, limitation of liability, indemnification, and governing law - survive termination.

12Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide reasonable notice (for example, by email or through the Service). Changes take effect when posted or on the date stated in the notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.

13Governing law & severability

These Terms do not designate a specific national or state law as their exclusive governing law. To the extent a governing law or venue must be determined for any dispute arising out of or relating to these Terms or the Service, it will be resolved under the applicable law of the relevant forum, and either party may seek injunctive relief in any court of competent jurisdiction.

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
